General Terms and Conditions of Simulator SBLS Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, revocable, non-transferrable license (without the right to sublicense) to access and use the SBLS solely as directed by HelpMeSee for your training with the HelpMeSee Eye Surgery Simulator. You are prohibited from using your access to the SBLS in any way that attempts to, or in fact does, tamper with or alter the SBLS. 

You are responsible for all activity conducted through your account. If there is unauthorized use by anyone who obtained access to the Services directly or indirectly through you, you will take all steps reasonably necessary to terminate the unauthorized use. You will cooperate and assist with any actions taken by HelpMeSee to terminate unauthorized use of the Services, the SBLS, and your account. 

a. You must ensure that all usernames and passwords required to access the SBLS are kept secure and confidential. You must immediately notify HelpMeSee of any unauthorized use of your passwords or any other breach of security and HelpMeSee will reset your password and you must take all other actions that HelpMeSee reasonably deems necessary to maintain or enhance the security of HelpMeSee’s computing systems and networks and your access to the Services.

b. As a condition of these Terms, when accessing and using the Services, you must:

i. not attempt to undermine the security or integrity of HelpMeSee’s computing systems or networks or, where the Services are hosted by a third party, that third party’s computing systems and networks;

ii. not use, or misuse, the Services in any way which may impair the functionality of the SBLS or impair the ability of any other user to use the SBL, including by misusing the SBLS in a manner that materially exceeds reasonable usage or use patterns over any month or by using the SBLS in a malicious, fraudulent, or unlawful manner;

iii. not attempt to gain unauthorized access to any materials other than those to which you have been given express permission to access or to the computer system on which the SBLS is hosted; 

iv. not attempt to modify, copy, adapt, reproduce, disassemble, decompile, or reverse engineer any computer programs used to deliver the SBLS except as is strictly necessary to use it for normal operation.

When using the Services, you may provide us with your first and last name, email, title, address, telephone number, photograph, and position (role) for the creation of a profile. As part of the training being provided to you on the HelpMeSee Simulator or through the SBLS, HelpMeSee collects and stores this user profile information from or about you to contact, identify, or locate you (“Personal Information”). 

We will collect, use store, and share the Personal Information to provide training and to analyze, operate, support, maintain, and improve the Services, as well as to perform associated technical administration. We also automatically track and collect certain non-personal information such as navigation data. We use this information to do internal research to better understand, protect and serve you and the SBLS training community. 

We will not disclose your Personal Information to another entity except when we need to share the information with an entity who works on our behalf or is engaged by HelpMeSee to: help HelpMeSee provide the training on the HelpMeSee Eye Surgery Simulator (these entities do not have any right to use the Personal Information we provide to them beyond what is necessary to assist us); or to assist us to analyze, operate, support, maintain and improve the SBLS and the HelpMeSee Eye Surgery Simulator; or to perform associated technical administration; or as it is otherwise necessary or as required or permitted by law. 

We may also disclose certain individual-level usage and performance information when the information has been converted to a form that cannot be used to identify you. We may use this information in order to provide analyses and aggregate statistics for development, product improvement, marketing, or other business-related purposes. This information will be “anonymized”, meaning that it will not contain information that will identify you and it will not be transferred or sold to third parties in any way or format that identifies you. 

We save your information in our databases in order to provide certain features of the SBLS training and improve your user experience and in accordance with these Terms. We employ reasonable security measures to protect data from unauthorized access, maintain data accuracy, and help ensure the appropriate use of data. These technologies help ensure that your information is safe and secure. But, as provided below, make no guarantees in this regard.
